Terms of Service

1. Subject matter

DREICH is a tabletop role-playing game in development, based on a d100 roll-under system. The Site presents the project, provides a facility to subscribe to a development newsletter, and provides a facility to create an account to which game materials may subsequently be attached.

The Site is made available free of charge. No goods or services are sold through the Site and no payment is accepted.

2. Eligibility

The Site may be used, an account created and the newsletter subscribed to only by persons who have attained the age of sixteen (16) years. By creating an account or subscribing, the User represents and warrants that this condition is satisfied and that the User is entitled to use the email address submitted.

3. Accounts and authentication

Authentication is effected either by means of Google or by means of a one-time code dispatched to the email address submitted by the User. No passwords are used. The first successful authentication creates the account.

Access to the User’s mailbox accordingly constitutes access to the User’s account. The User is responsible for the security of that mailbox and of any device used to access the Site. Any action performed following a successful authentication shall be deemed to have been performed by the User.

The User shall notify the Provider at dreichgames@gmail.com without undue delay upon becoming aware of any unauthorised use of the account.

The User may request deletion of the account at any time by written request to dreichgames@gmail.com.

4. Acceptable use

The User shall not:

• access or attempt to access the account of another User, or any part of the Site, its application programming interface or its infrastructure not intended for the User;
• circumvent or attempt to circumvent authentication, rate limiting or any other technical restriction;
• submit automated requests to the Site or its application programming interface in a volume liable to impair its operation or availability;
• submit an email address the User is not entitled to use, or submit false or misleading information;
• reproduce, extract, adapt or distribute the materials of the Site otherwise than as permitted by Clause 5;
• use the Site for any unlawful purpose or in breach of any applicable law.

The Provider may suspend or terminate access and delete any account with immediate effect and without prior notice where the Provider reasonably considers that these Terms have been breached.

5. Intellectual property

The designation DREICH, the texts, the game rules and mechanics, the artwork, the graphic design, the source code and all other content of the Site are the property of the Provider and are protected by copyright and other intellectual property rights. The artwork consists of preliminary concept sketches for the project.

The User is granted a limited, non-exclusive, non-transferable and revocable licence to access and read the Site for personal, non-commercial purposes and to share hyperlinks to it. Any other use, including reproduction, extraction, adaptation, translation, communication to the public or distribution, in whole or in part, requires the prior written consent of the Provider.

Where quick-start rules or other materials are released, the terms governing their use shall be stated in the relevant document and shall prevail over this Clause in respect of those materials.

6. Newsletter and electronic communications

Subscription constitutes consent to receive electronic messages concerning the development of DREICH. No third-party advertising is dispatched and no subscriber address is disclosed to any third party for that party’s own mailings.

Consent may be withdrawn at any time by written request to dreichgames@gmail.com and, where an unsubscribe facility is provided within a message, by means of that facility. Withdrawal takes effect without undue delay and in any event within seven (7) days of receipt.

Messages relating to authentication, security and administration of the account are service communications, are not promotional, and are dispatched for as long as the account exists.

7. Availability and modification of the service

The Site is under development. The Provider may at its discretion modify, suspend, restrict or discontinue the Site or any part of it, including accounts and the newsletter, at any time, without prior notice and without liability.

The Provider gives no undertaking as to uninterrupted or error-free operation, and no undertaking as to any release date of the game or of any materials.

8. Disclaimer of warranties

The Site is provided “as is” and “as available”. To the fullest extent permitted by applicable law, the Provider excludes all warranties, conditions and representations, whether express or implied, including as to merchantability, fitness for a particular purpose, accuracy and non-infringement.

9. Limitation of liability

To the fullest extent permitted by applicable law, the Provider shall not be liable for any indirect, incidental, special, consequential or punitive damages, for loss of profit, revenue, goodwill or data, or for any interruption of business, arising out of or in connection with the use of, or inability to use, the Site, irrespective of the basis of the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that may not be excluded or limited under applicable law. Where mandatory consumer protection rules apply to the User, those rules prevail over this Clause.

10. Indemnity

The User shall indemnify and hold the Provider harmless against any claim, demand, loss or expense, including reasonable legal fees, arising out of the User’s breach of these Terms or of any applicable law.

11. Term and termination

These Terms apply for as long as the User uses the Site. The User may terminate at any time by ceasing to use the Site and requesting deletion of the account. Clauses 5, 8, 9, 10, 14 and 15 survive termination.

12. Personal data

The processing of personal data is governed by the Privacy Policy, which forms an integral part of these Terms.

13. Amendments to these Terms

The Provider may amend these Terms. The amended version enters into force upon publication on this page, the date stated at the head of the page indicating the date of the last amendment. Material amendments shall be notified to account holders and subscribers by email not less than ten (10) days before they take effect. Continued use of the Site after entry into force constitutes acceptance of the amended Terms.

14. Governing law and jurisdiction

These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by the law of Ukraine. Any dispute that cannot be resolved by correspondence shall be submitted to the competent courts of Ukraine, without prejudice to any mandatory rule of the User’s country of habitual residence conferring jurisdiction elsewhere.

15. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. A failure to enforce any provision shall not constitute a waiver of it.

The User may not assign any right or obligation hereunder without the prior written consent of the Provider. The Provider may assign these Terms in connection with a transfer of the project.

These Terms, together with the Privacy Policy, constitute the entire agreement between the parties in respect of the Site.

These Terms are published in Ukrainian and in English. In the event of divergence between the two versions, the Ukrainian version prevails.
